Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Twisted Pickle LLC doing business as Twist ("Twist," "we," "us," or "our"). They govern your use of twisttourneys.com and the Twist tournament management platform (together, the "Service").
By creating an account or using the Service, you agree to these Terms. If you don't agree, don't use the Service.
1. Who can use Twist
You must be 18 or older to create an account. By creating one, you confirm that you are at least 18 and legally able to enter into this agreement.
Junior players may compete in events managed on Twist, but a parent, legal guardian, or tournament director must register them using that adult's account. If you register a minor, you are responsible for that registration, for the accuracy of the information you provide, and for the minor's conduct at the event.
You may not use the Service if we've previously terminated your account.
2. Your account
You're responsible for:
Providing accurate information and keeping it current
Keeping your password confidential
Everything that happens under your account
Tell us immediately at support@twisttourneys.com if you believe your account has been compromised. We're not liable for losses caused by someone else using your account with or without your knowledge.
Don't share your account, and don't create an account for someone else without their permission.
3. What Twist is — and what it isn't
Twist is software that helps tournament directors run events. We provide the tools: registration, brackets, scheduling, court assignment, scoring, and results.
We do not organize, host, sanction, officiate, or supervise tournaments. Those are run by independent tournament directors and facilities. They set the rules, formats, entry fees, refund policies, schedules, and codes of conduct for their own events. They are not our employees, agents, or partners, and we don't control them.
This means:
Disputes about an event — results, seeding, officiating, conduct, facilities, or refunds — are between you and that tournament director
We don't guarantee any event will happen, happen on time, or happen as described
We're not responsible for a tournament director's actions, omissions, or decisions
We'll help where we reasonably can, but the tournament director is the responsible party for their event.
4. Entry fees, payments, and refunds
How payments work
When you pay an entry fee through Twist, the payment is collected on behalf of the tournament director running that event. Payments are processed by a third-party payment processor; we don't store your full card details.
Refunds
Refund policies are set by the tournament director, not by Twist. Each event's refund policy is shown at registration. Read it before you pay.
Refund requests go to the tournament director for that event. We can help facilitate, but we do not decide whether a refund is owed and we do not issue refunds on a director's behalf unless the director instructs us to.
If an event is cancelled, the tournament director is responsible for refunds under their stated policy.
Fees
Twist may charge tournament directors a platform fee, and may charge players a service or processing fee on top of the entry fee. Any fee charged to you is disclosed before you pay. Service and processing fees are generally non-refundable even when an entry fee is refunded, unless we say otherwise.
Chargebacks
If you dispute a charge with your bank rather than working through the tournament director or us, we may suspend your account while the dispute is resolved.
5. Assumption of risk
Pickleball is a physical sport and carries risk of injury.
You participate in tournaments at your own risk. Twist does not inspect facilities, verify safety conditions, supervise play, or provide medical support. Those are the responsibility of the tournament director and the venue, and you will typically sign a separate waiver with them.
You agree that Twist is not responsible for any injury, illness, death, or property damage arising from your participation in any event, or from your presence at any venue.
6. Code of conduct
Twist is used by a community. When using the Service or participating in events managed through it, you agree not to:
Harass, threaten, abuse, or discriminate against anyone
Misrepresent your skill level, age, or identity to gain a competitive advantage
Manipulate results, sandbag, or otherwise cheat
Register another person without their permission
Upload content that's unlawful, defamatory, obscene, or infringes someone else's rights
Interfere with the Service, attempt to gain unauthorized access, scrape data, or introduce malicious code
Use the Service for anything illegal
Report conduct concerns to conduct@twisttourneys.com. We may investigate, and we may suspend or terminate accounts for violations. Serious conduct issues at an event are also the tournament director's responsibility to address.
7. Photos, video, and your likeness
Tournaments are public events. Photos and video may be captured at them and uploaded to Twist by us, tournament directors, facilities, or other participants.
By participating in an event managed on Twist, you grant us a non-exclusive, royalty-free license to use images and video of you captured at that event for purposes of displaying event results and coverage, and for promoting Twist and the events on it.
If you'd prefer an image of you not appear, email privacy@twisttourneys.com and we'll remove it from the Service promptly.
8. Content you upload
You keep ownership of the content you upload — profile photos, messages, event details, and anything else.
By uploading it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, reproduce, and distribute it as needed to operate and promote the Service.
You're responsible for what you upload. Don't upload anything you don't have the right to share.
We may remove content that violates these Terms, but we're not obligated to monitor or review content.
9. Results and event data
Tournament results — including your name, division, seeding, scores, standings, and placement — are part of the public record of an event. They may be displayed publicly, retained indefinitely, and shared with rating systems, sanctioning bodies, and event organizers.
You can't require us to delete competitive results, even if you close your account. This is how competitive sport records work.
10. Our intellectual property
The Service — including the Twist name, logo, software, design, and content we create — belongs to us and is protected by intellectual property law.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. You may not copy, modify, reverse-engineer, resell, or create derivative works from the Service without our written permission.
11. Beta service
Twist is currently in Beta. The Service is provided as-is and may contain bugs, may be interrupted, and may change or be discontinued without notice. Features may be added, altered, or removed. Data may occasionally be lost despite our efforts.

12. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.
To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
We don't warrant that the Service will be uninterrupted, error-free, secure, or that defects will be corrected. We don't warrant the accuracy or reliability of any content, including event information provided by tournament directors.
13. Limitation of liability
To the fullest extent permitted by law, Twist and its owners, officers, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, or loss of goodwill, arising from or related to your use of the Service.
Our total liability to you for any claim arising from or related to the Service will not exceed the greater of (a) the total amount you paid us in the twelve months before the claim arose, or (b) one hundred U.S. dollars ($100).
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.
14. Indemnification
You agree to indemnify and hold harmless Twist and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, your violation of any law, or your infringement of anyone's rights.
15. Termination
You can close your account any time by emailing support@twisttourneys.com.
We may suspend or terminate your access at any time, with or without notice, if you violate these Terms, if we believe your conduct creates risk or legal exposure, or if we discontinue the Service.
Sections that by their nature should survive termination — including results and event data, intellectual property, disclaimers, limitation of liability, indemnification, and governing law — survive.
16. Changes to these Terms
We may update these Terms as Twist develops. When we make material changes, we'll update the date at the top and notify you by email or through the Service before they take effect.
Continuing to use the Service after changes take effect means you accept the updated Terms. If you don't accept them, stop using the Service and close your account.
17. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules.
Any dispute arising from or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Dallas County, Texas, and you consent to the personal jurisdiction of those courts.
Before filing anything, please contact us at support@twisttourneys.com. Most disputes can be resolved quickly and informally, and we'd much rather do that.
18. General
Entire agreement. These Terms and our Privacy Policy are the complete agreement between you and us about the Service.
Severability. If any provision is found unenforceable, the rest stays in effect.
No waiver. If we don't enforce a provision, that doesn't waive our right to enforce it later.
Assignment. You can't assign these Terms without our written consent. We may assign them in connection with a merger, acquisition, or sale of assets.
